Right to Decide End of Life Care.

Representing members of a closely-knit family, our Succession Planning team successfully defended the family’s right to advocate for and obtain the treatment desired by the family’s hospitalized, seriously ill matriarch.

A national health care institution initiated a guardianship petition in Suffolk County Probate Court, seeking not only to revoke the health care proxy of this elderly and hospitalized woman, but also a judicial order authorizing the cessation of life-sustaining medical treatment.  These demands went directly against the strongly expressed desires of the woman and her family.

Aggressively litigating on the family’s behalf, our team vindicated the right of the patient and her family to make their own decisions about her end of life care.  We secured dismissal of all claims by the health care institution.
