Successful Defense of City in Federal Civil Rights Case.

When the City of Chelsea was sued by a local church alleging violation of its First Amendment rights, our Tax Title Recovery team  persuaded the court that the Federal Tax Injunction Act barred the lawsuit.

The City was sued by a church claiming that it was entitled to a religious tax exemption. The City refused to apply the tax exemption to a new property acquired by the church. The church argued that the City’s actions violated the Free Exercise and Establishment Clause of the First Amendment of the United States Constitution and that it was entitled to an injunction and an award of monetary damages.

Our Tax Title Recovery litigators quickly moved to dismiss the lawsuit for lack of jurisdiction based upon the Tax Injunction Act. The court held that the argument was correct and dismissed the complaint.
