Federal Civil Rights case against Town dismissed before trial.

Our litigators obtained pre-trial dismissal of a federal civil rights lawsuit against the Town of Norfolk and its code inspectors. A real estate developer brought a lawsuit alleging that the Town’s inspectors engaged in retaliatory code enforcement in retaliation for his complaints about their conduct and decisions on development projects. In addition to alleging federal civil rights violations, the developer also alleged violation of the Massachusetts Civil Rights Act, interference with contractual relations and civil conspiracy.

We quickly moved to dismiss the entire lawsuit on the grounds that the alleged retaliatory code enforcement was both factually and legally deficient.  The Court agreed with our arguments and dismissed the entire case.
